BAY CAFE DEMOLITION DELAYED
Many congratulations and thanks to all those people who wrote in to express their objections to the demolition of the Bay Cafe. The following notice (see link below) has been issued by SHDC’s planners who want more information prior to any demolition. Until the details are provided, demolition cannot proceed without penalty. The delay should provide time for the two outstanding appeals (against the ACV designation & against the refusal of planning permission for 4 houses on the site) to be decided.

Bigbury Parish Council has responded to the application to demolish the Bay Cafe, Asset of Community Value, with the following letter to SHDC. Given the level of public interest in this matter, the Clerk has agreed to the publication on this website.

The following link will take you to the South Hams Planning portal where Gallion Property Developers have just made an application to demolish Warren Cottage/Bay View Cafe after the 18 January.
Our District Councillor, Beth Huntley, is up a mountain in the Himalayas and cannot coordinate the response – she has asked for your help via Charterlands Chatter Facebook.
Its up to you to do what you can as quickly as possible. It takes up to 3 days for an Objection to be posted on the South Hams website once you have pressed the submit button and we only have until 18 January.

1. Forward this note to anyone whom you think would want to stop this demolition and ask them to object to the permission to demolish.
2. Make an Objection yourself as quickly as possible.
The issues are many but these include
Planning Permission was refused by the SHDC for 4 luxury houses on this site. Gallion have not yet heard back from the Inspector who heard their Appeal against the refusal,
The buildings were designated a Community Asset of Value by the due legal planning process. The developers have also appealed against this CAV designation and the relevant tribunal will not be held until April/May 2018.
By applying to demolish what was clearly designated as a Community Asset by the local planning authority, the developers have shown an utter contempt for the local community and for the national planning process.
They should withdraw their application for demolition until AFTER the outcome of their APPEAL against Planning Permission is known.
The South Hams Council should not have accepted a planning Application for Demolition until AFTER the Appeal processes were completed.
This is a national issue and you are urged to write to the local newspapers and voice your concerns about this as a matter of principle.
Re : CR/2017/0019 : Galion Homes (Bigbury) Limited vs South Hams District Council
Galion Homes (Bigbury) Ltd is taking the rejection of its appeal against the Asset of Community Value listing by SHDC of Bay View Cafe and Warren Cottage to a Tribunal, which is likely to take place in April/ May of 2018.
This is distinct from the appeal by the same company against the rejection by SHDC of the planning application to demolish Warren Cottage and the Bay View Cafe, to replace them with 4 houses, which has been heard over 19th/ 20th December 2017 in the Memorial Hall and will be decided within 4-6 weeks.

The second day of the Bay cafe appeal will start tomorrow (Wednesday 20th) at 0930. It’s really bringing the community together to sing with one voice. Be there in the Memorial Hall to enjoy the ebb and flow of the debate from both sides. Who can guess which way the Inspector will move? As good as any TV drama!

BAY VIEW CAFE – COMMUNITY ASSET OF VALUE
There was an impromptu gathering of parishioners at ‘Mariners’, home of Pat & Jim Chadwick, immediately above Bay Cafe, on 20th June to celebrate the listing of Bay View Cafe as an Asset of Community Value by SHDC. The gathering took place at very short notice and, therefore, was only a small representation of the strength of feeling in the parish that the cafe or something like it, should be retained for the enjoyment of this idyllic setting by residents and visitors alike.
